Previously convicted felon arrested after found hiding in a storage shed

On Dec. 11, Independence County Deputies Jason Cole and Tyler Cunningham responded to a call at 10 Edith St. in Magness.

Upon arrival, deputies spoke with Ashlyn Treadway who lives at the property where the storage building is located.

Treadway states when she arrived home from work, her dogs ran to the storage building and were acting like something, or in this case, someone was inside. Treadway went out to look inside the building. She found Shawn Edward Smart, 45, hiding from her.

Treadway then called authorities. When the deputies arrived, they confronted Smart.

The official report states that Smart had been previously warned to not be on the property since he had been caught by Treadway a few days prior to the incident. Treadway said she had caught him on game cameras peering into the windows of her property and has contacted the department on those occasions.

Smart was taken into custody at the time for breaking or entering into the building. Breaking or entering into a building is a Class D felony. 

Smart was placed on a $10,000 bond. Formal charges are pending. Det. Michael Moody is requesting Smart be charged as a habitual offender due to his history of felony convictions.
